Agreement to Terms
These Terms of Service ("Terms") govern your use of the Vision Nacional website and solar monitoring services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our website or services.
Service Description
Vision Nacional provides solar energy monitoring services for residential and commercial photovoltaic installations. Our services include:
- Assessment of existing solar installations
- Installation of monitoring hardware and sensors
- Configuration of monitoring systems
- Access to monitoring dashboards and mobile applications
- User training on data interpretation
- Ongoing technical support
We are monitoring specialists and do not perform solar panel installation, repair, or maintenance services.
Service Agreement
When you engage our monitoring services, a separate service agreement will be provided detailing specific terms including:
- Scope of services to be provided
- Equipment specifications and installation details
- Service fees and payment terms
- Warranty coverage and limitations
- Service duration and renewal terms
The service agreement supersedes these general Terms with respect to the specific services provided.
User Responsibilities
When using our services, you agree to:
- Provide accurate information about your solar installation
- Maintain internet connectivity required for monitoring system operation
- Protect your dashboard login credentials and not share them with unauthorized parties
- Notify us promptly of any suspected security breaches or unauthorized access
- Use monitoring data for lawful purposes only
- Not attempt to reverse engineer, modify, or interfere with monitoring equipment or software
Equipment and Installation
Monitoring equipment remains the property of Vision Nacional unless otherwise specified in your service agreement. You agree to:
- Allow reasonable access to your property for installation and maintenance
- Protect installed equipment from damage or tampering
- Not relocate or modify equipment without our authorization
- Return equipment upon service termination if required
We are not responsible for damage to your property during installation unless caused by our negligence.
Data Accuracy and Limitations
While we strive to provide accurate monitoring data, you acknowledge that:
- Monitoring systems may experience temporary data interruptions due to connectivity issues
- Sensor accuracy is subject to manufacturer specifications and environmental factors
- Historical data comparisons are informational and may not account for all variables
- We are not responsible for decisions made based on monitoring data
Monitoring data should be used as one factor in assessing solar system performance, not as the sole basis for maintenance or repair decisions.
Service Availability
We aim to maintain continuous monitoring service availability. However, service may be temporarily unavailable due to:
- Scheduled maintenance and system updates
- Internet connectivity issues at your property or our data centers
- Equipment malfunctions or failures
- Events beyond our reasonable control
We will make reasonable efforts to notify you of scheduled maintenance in advance.
Fees and Payment
Service fees are specified in your service agreement. Payment terms include:
- Fees are due according to the schedule in your service agreement
- Late payments may result in service suspension
- Fee adjustments will be communicated with reasonable notice
- Refund policies are detailed in your service agreement
Intellectual Property
All content on our website, including text, graphics, logos, software, and monitoring dashboard interfaces, is the property of Vision Nacional or our licensors and is protected by intellectual property laws. You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks or branding without authorization
- Reverse engineer our software or monitoring systems
- Create derivative works based on our services
Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages arising from service use
- Our total liability is limited to the fees paid for services in the twelve months preceding the claim
- We are not responsible for losses resulting from your reliance on monitoring data
- We are not liable for damage caused by factors outside our reasonable control
These limitations do not affect liability that cannot be excluded under Spanish law.
Warranty Disclaimer
Services are provided "as is" without warranties of any kind, express or implied. We do not warrant that:
- Services will be uninterrupted or error-free
- Monitoring data will be completely accurate at all times
- Defects will be corrected immediately
- Services will meet your specific requirements
Termination
Either party may terminate services according to the terms specified in your service agreement. Upon termination:
- You must cease using monitoring dashboards and applications
- We may remove monitoring equipment from your property
- Historical data may be deleted after a reasonable retention period
- Outstanding fees remain due and payable
Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of modified Terms. Significant changes will be communicated to active clients.
Governing Law
These Terms are governed by Spanish law. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
